Toury Terms of Service

Privacy Policy Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and ResearchBase (“we,” “us,” “our”), the operator of the Toury service (“Toury” or the “Service”). By installing the Toury app, pairing your phone number, or calling or texting the Toury phone number, you accept these Terms. If you do not accept them, do not use the Service.

1The Service

Toury is a personal AI driving companion. After pairing your mobile number in the Toury app, you may call or text the Toury phone number to converse with an artificial-intelligence assistant. When you enable the location beacon in the app, the assistant may use your live location to answer questions about your drive and surroundings. The Service is offered in the United States.

The Service is an early-stage product provided on an experimental basis. Features may change, malfunction, or be discontinued at any time without notice.

2Eligibility

You must be at least 18 years old and, if using the Service while operating a vehicle, hold a valid driver’s license. By using the Service you represent that you meet these requirements.

3Your Responsibilities

You agree to: (a) pair only phone numbers that you own or control; (b) provide accurate information during pairing; (c) maintain the security of your device — anyone with your phone can interact with the Service as you; and (d) notify us promptly if your number changes ownership.

4Messaging Terms

By pairing, you consent to receive from the Service: (i) a one-time verification passcode, and (ii) conversational replies to communications you initiate. Message frequency varies with your usage. Message, data, and call rates may apply and are your responsibility. Reply STOP to stop receiving messages, HELP for help. Consent to messaging is not a condition of any purchase. Mobile carriers are not liable for delayed or undelivered messages.

5Safety and Vehicle Operation — Read Carefully

You are solely and entirely responsible for the safe operation of your vehicle at all times.

  • Use the Service only in hands-free mode while driving, and only where and when it is legal and safe to do so.
  • Comply at all times with all applicable laws regarding mobile-device use while driving.
  • Never read, type, or send text messages while driving. The SMS features of the Service are for use only when you are not operating a vehicle.
  • If any interaction with the Service requires your visual attention, pull over safely first.
  • The Service is a source of conversation and general information — it is not a navigation system, driver-assistance system, or safety device, and must never be treated as one.

To the maximum extent permitted by law, we are not responsible or liable for any accident, injury, death, property damage, traffic violation, or other harm arising from or related to your operation of a vehicle while using, or distracted by, the Service.

6AI-Generated Content Disclaimer

Responses are generated by artificial-intelligence systems and may be inaccurate, incomplete, outdated, or misleading, including information about streets, locations, distances, directions, and nearby places. The Service may misidentify where you are. You agree not to rely on the Service for navigation, routing, emergency response, or any decision where inaccurate information could cause harm, including medical, legal, financial, or safety decisions. Nothing the Service says constitutes professional advice of any kind. You are responsible for independently verifying any information before acting on it.

7Not an Emergency Service

The Service cannot place emergency calls, contact 911, or summon assistance. In an emergency, contact emergency services directly.

8Location Data

Enabling the beacon transmits your device’s precise location to our servers as described in the Privacy Policy. You may stop this at any time by turning off the beacon or revoking location permission. You acknowledge that location readings depend on your device’s GPS and network conditions and may be inaccurate or unavailable.

9Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) pair or attempt to pair numbers you do not own, or spoof caller ID; (c) attempt to access other users’ data or probe, disable, or circumvent security measures; (d) reverse engineer, scrape, or extract the Service’s underlying prompts, models, or software except as permitted by law; (e) use the Service to harass, defame, or harm others; (f) transmit malware or interfere with the Service’s operation, including by excessive automated usage; or (g) resell or commercially exploit the Service without our written consent. We may suspend or terminate access for violations.

10Intellectual Property

The Service, including its software, design, and branding, is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App and Service for personal, non-commercial purposes. You retain ownership of the content of your messages; you grant us a license to store and process that content as needed to operate the Service as described in the Privacy Policy.

11Third-Party Services

The Service depends on third-party providers — telephony carriers, cloud hosting, AI model providers, and open map-data sources. We do not control these providers and are not responsible for their availability, accuracy, or acts or omissions. Map and place information is derived in part from community-maintained sources and may be incorrect or out of date.

12Fees

The Service is currently provided without a subscription fee. Your carrier’s standard voice, messaging, and data rates apply and are solely your responsibility. We may introduce fees in the future with advance notice; continued use after notice constitutes acceptance.

13Privacy

Our collection and use of information is governed by the Toury Privacy Policy, which is incorporated into these Terms by reference.

14Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including to protect the Service or other users. You may stop using the Service at any time by unpairing your number and deleting the App. Sections 5–7, 10, 15–18, and 20 survive termination.

15Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED BY THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) IN NO EVENT WILL WE, OUR OFFICERS, EMPLOYEES, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THE LIMITATIONS IN THIS SECTION ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND US.

17Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use or misuse of the Service; (b) your violation of these Terms or of any law; (c) your operation of a vehicle; or (d) your violation of any third party’s rights.

18Dispute Resolution; Class Action Waiver

Before filing any claim, you agree to first contact us at the email below and attempt in good faith to resolve the dispute informally for 30 days. Any dispute not so resolved shall be resolved by binding individual arbitration or in small-claims court, and you and we each waive the right to a jury trial and to participate in a class action, to the extent permitted by law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

19Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including carrier or provider outages, natural disasters, or governmental actions.

20General

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. We may modify these Terms at any time by posting the revised version at this URL with an updated effective date; continued use constitutes acceptance.
